AUCTION TERMS AND CONDITIONS
AUCTION END TIME: This Auction is a timed event with the end time posted. Atterberry Online Only Real Estate Auctions have an auto extend feature. Any bid placed within 10 minutes of the Auction ending will automatically extend the auction for 10 minutes from the time the bid is placed. Example: If an Auction scheduled to end at 6:00PM receives a Bid at 5:59PM, the close time of the auction automatically extends to 6:09PM. The Auto-Extend Feature remains active until no further bids are received within the 10 minute time frame.
AUCTION INSPECTION DATE: Monday, March 11th From 4:30 p.m. to 6 p.m.
BIDDER VERIFICATION: The identity of all bidders will be verified, bidding rights are provisional, and if complete verification is not possible, Atterberry Auction & Realty Co. will reject the registration and their bidding will be terminated.
REGISTRATION: All bidders must provide name, address, phone number, social security number, and a valid driver’s license. By registering, all bidders acknowledge having read and agree to be bound by the Auction Terms and Conditions.
DOWN PAYMENT: A 4% Buyer’s Fee Is In Effect - A 4% buyer’s fee will be added to your bid to determine the final contract sale price. The Real Estate is Offered “AS IS” - with no guarantee or warranty of any type - no contingencies. A cashier’s check or a wire transfer in the amount of $10,000.00 (non-refundable deposit/Earnest money) due within 24 hours of conclusion of this sale. Cash closing within 30 days is required. The ability to obtain financing is NOT a contingency of the sale. Make certain you have arranged financing if needed and are capable of paying cash at the closing. If you default on the contract then you forfeit your Earnest Money. You are urged to thoroughly inspect the property and complete your own due diligence before you bid.
FINANCING: Financing is not a contingency of sale in this offering. Therefore, it is strongly recommended that potential bidders ensure in advance that they are able to obtain the necessary financing to close the transaction.
CONTRACT SIGNING: Contract Documents will be sent by e-mail or fax to the successful bidder, who must execute and fax or email back to Atterberry Auction & Realty within 24 hours of the end of the auction.
CLOSING: Buyer shall close within 30 days of the auction date. Possession will be delivered at closing.
EVIDENCE OF TITLE: Seller shall furnish at seller’s expense an Owner’s Policy Of Title Insurance in the amount of the total purchase price and shall execute a warranty deed conveying the real estate to the buyer.
REAL ESTATE TAXES & ASSESSMENTS: Any unpaid 2012 calendar year taxes shall be paid by the Seller at closing. The 2013 taxes are to be prorated as of the closing date.
AGENCY: Atterberry Auction & Realty Co., LLC and its representatives are Exclusive Agents of the Seller.
Reserve: The seller is very motivated to sell this home, as they have moved. The seller does retain the right to confirm or approve the final bid.
BROKER PARTICIPATION: A commission will be paid to any properly licensed Broker who registers a successful buyer according to the Broker Participation Agreement. This form is available from the Auction Company and must be completed and returned no later than March 16th @ 6:00PM CST.
